Green Card Alert: October Visa Bulletin Updates for India
Bharatmorning.com – Green Card alert: The October 2026 Visa Bulletin brings renewed movement for several India-born employment-based applicants as visa numbers become available for fiscal year 2027. EB-2 and unreserved EB-5 are available again after being unavailable in September, while the EB-1 cutoff for India has also advanced.
EB-2 and Unreserved EB-5 Reopen
India’s EB-2 category is available again in October. This category generally includes professionals with advanced degrees and people who can demonstrate exceptional ability. Its Final Action Date is November 1, 2013, meaning applicants must have priority dates earlier than that cutoff to be eligible for final approval, assuming all other requirements are met.
The unreserved EB-5 investor category for India has also reopened, with a Final Action Date of December 1, 2023. Both EB-2 and unreserved EB-5 had been unavailable in September, preventing otherwise eligible cases from reaching final approval.
Final Action Dates determine when an immigrant visa or adjustment-of-status application may be approved. They are different from the Dates for Filing chart, which can affect when an applicant may submit an adjustment application.
India EB-1 Cutoff Advances
India-born EB-1 applicants received another favorable change. The Final Action Date moved from October 15, 2022, to February 1, 2023. EB-1 covers priority workers, including individuals with extraordinary ability, outstanding professors and researchers, and certain multinational managers or executives.
This advance may allow more applicants with qualifying priority dates to move forward. However, applicants whose dates fall after the new cutoff will still need to wait for future bulletin movement.
Family-Based F2A Category Moves Forward
The F2A family-based category also showed progress. F2A applies to spouses and unmarried children under 21 of lawful permanent residents. For most countries, including India, China, and the Philippines, the Final Action Date advanced from August 22, 2026, to September 22, 2026.
Mexico saw a larger change, moving from August 22, 2025, to March 22, 2026. Even modest movement can matter for families waiting for permanent-residency processing, though cutoff dates can advance, remain unchanged, or move backward in later months.
Setbacks Elsewhere in Employment-Based Processing
Not every category benefited from the October bulletin. Some employment-based categories affecting most countries, Mexico, and the Philippines moved backward as annual visa-number limits were managed.
National Interest Waiver applicants outside India faced a notable retrogression, with the Final Action Date moving back to January 1, 2025. Retrogression can pause final approval for applicants whose priority dates had previously been current enough to proceed.
Former senior USCIS official Ricky Murray described the bulletin as containing “the bad,” “the good,” and “the curious,” referring to both the reopened India categories and the setbacks in other classifications.
“That demand is impractical and largely unachievable,” Murray stated to Newsweek.
Murray criticized the timing of the October bulletin’s release, saying affected applicants had fewer than two days to prepare and submit petitions or applications to USCIS. For cases affected by a narrow filing window, delays involving documents, signatures, medical requirements, or legal review can be consequential.
What Indian Applicants Should Do Now
This Green Card alert is a reminder to check both the Visa Bulletin and USCIS filing guidance before taking action. USCIS may specify whether adjustment-of-status applicants can use the Final Action Dates chart or the Dates for Filing chart in a particular month.
Applicants should confirm their priority date, employment-based category, country of chargeability, and the applicable USCIS chart. Being eligible to file does not necessarily mean a green card can be approved immediately.
FAQ for Indian Green Card Applicants
Does an available EB-2 category mean every Indian applicant will receive a green card?
No. The applicant’s priority date must be earlier than the October EB-2 Final Action Date of November 1, 2013, and all eligibility and processing requirements must be satisfied.
What does the EB-1 advance mean for applicants from India?
Applicants with priority dates earlier than February 1, 2023, may be able to proceed to final approval if their cases are otherwise ready. Applicants with later dates remain subject to future Visa Bulletin movement.
Should applicants file immediately after seeing this Green Card alert?
Applicants should first verify the chart USCIS has authorized for that month and review their individual case status with qualified immigration counsel where appropriate. Filing eligibility and final approval eligibility are not the same.
